ShadowControl Notification - Failed Backup Job Limit Exceeded

The Shadow Control sends me email alerts with this meesage

"ShadowProtect - Failed Backup Job Limit Exceeded: A backup job has been failing for 61 minutes. Review the system's backup history"

When I review the history for that day there is one warning saying 

"The snapshot did not use the Volume Shadow Copy Service (VSS)"

The rest are successful backups. Is the VSS issue causing this error?
